Driver side rear tire's outer sidewall rubbing wheel well?

So, I've recently purchased new tires for my 98 M3 sedan. When I bought it, it had 225/45 17's all the way around the car. I decided to go back to the staggered set up, 225/45 front and 245/40 on the rear. Ever since then, the driver side rear tire's outer side wall makes contact with the inner fender while corner at any speed over 45 mph. I took it to a local euro shop and they said that my car had been lowered and needed factory springs to accommodate the factory recommended tire's. So I purchased some factory springs. It raised the ride height of the car, but it didn't really solve the problem. I knew I had to have it re-aligned so I took it back in today and asked them if there was a bushing that was bad, but they insisted that I have 3, 8x17's and one 9x17 (they didn't check the casting or take the tire off, they said they "measured them"). Now I have what looks like the factory forged m double spoke wheels. I haven't personally checked the wheel, but based on me being the third owner and the car being completely stock, I can't imagine why it would have just one wheel that was wider than the other 3. I also called BMW, discovering the factory wheel size is 7.5x17 up front and 8.5x17 for the rear. (Assuming those aren't replica wheels). The people who installed the tire also didn't note anything (discount tire). I'm assuming that the shop is wrong and I'm wondering what could go bad to cause that problem. The passenger rear doesn't do that. Just the driver side. Is there a bushing that goes out that could cause that?

Post a picture of all 4 of your valve stems.

    Thank you,

Okay. I'll get the pictures tomorrow when it isant dark. What will the valve stems tell?

The width of the LTW's. The wheels I assume you have.

So I've checked the wheels and they are the LTW wheels (checked the castings in the back of the wheel and they have the numbers by the valve stems). However, one of them (the one rubbing) is the 8.5x17 and the other is the 7.5x17(I'm not sure why I don't have 2 8.5's on the back) and the shop I had my car at isn't convinced that isn't the 8.5 is right size wheel for the rear of the car and won't touch it until I put a 7.5 on it.

Check your spare, it just may be an 8.5".

Which 245 tires do you have installed? Some 245's are quite wide.

This^^^ I had a Conti DW recently installed with a 5 mm spacer. Passenger rear rubbed ever so slightly on hard left turns or dips with a passenger.

I removed the spacer and we're all golden!
