    Court day

I have a court day tomorrow and I need some help arguing my ticket. I was going 35 in a 25. He pulled me over but didnt use radar or trail me. What stuff should I say to the judge. Oh I live in California

Ask how he determined your speed. Probably by estimate. In Mass you must have 2 methods of speed identification (usually estimated and radar) to issue you a ticket. How long could he have seen you? The difference in distance traveled is slim between 35 and 25. According to my calculations when you are traveling 35 mph you are covering 513 feet per second (35 miles x 5280 per mile =184800 feet in 1 hour. 184800 feet divided by 60 minutes divided by 60 seconds). Using the same formula, you cover 367 feet per second traveling at 25. So if he saw you at a distance of 1000 feet you would have passed him in 1.95 seconds doing 35 mph or 2.72 seconds doing 25. You can therefore explain to the judge that you don't think it is reasonable that the officer could determine that the difference between your speeding and not speeding was .77 seconds. That seems like a hard instant to perceive. If the distance is longer add the fact that he had to acquire you as a visual target and track you. That adds time.

    Good luck.

One more quick note... During your arguments do NOT admit to ANYthing that is against the law. In other words, if the judge asks if you might have been going say, 30, instead of 35, don't admit that, since it's also over the speed limit. I've seen cases where the defendant admitted to maybe 2 or 3 mph over the limit (instead of the 10 or 15 the officer suggested), and the judge slammed them. Just something to keep in the back of your head while arguing. Good luck.

        "513 feet per second"

DAMN! now THAT is fast. 2.5 football fields in 1 second? NO WONDER YOU GOT A TICKET! ;-)

possibly forget a decimal place in there somewhere? lol

So.. according to your math at 35 mph someone can go lengh of a almost 1.5 football fields in a second? :chair:

Last I chcked.. 60 mph = 88 feet per second..

            Little wrong....little right.

Football field is 100 YARDS or 300 FEET.

Math is wrong....sorry, but the concept is right.

88 feet per second at 60 mph (Sirius).

lets try again: 35 miles in 60 minutes = .5833 miles in 1 minute so 3080 feet in 60 seconds = 51.33 feet in 1 second.

At 25 miles in 60 minutes =.4167 miles in 1 minute so 2200 feet in 60 seconds = 36.67 feet in 1 seconds.

While not as easy an arguement as my prior math to defend, the concept is the same. With a car coming right at you he cop has to be able to differentiate speed with no other reference. Unless there were painted markers in the road this is almost impossible on only a alleged 10 mph speed differential. The shorter the distance he had observed you the better the arguement as well. A cop who is parked around a corner, or hidden helps with this defense.

Sorry again guys....VERY long day at work and was not thinking as clearly as I am now after my 1 hour ride home with the top down!

The distance i traveled was not that far. The cop was talking to someone when he saw me drive by him. It was during school hours and he was on a dirt bike. Some more info that might help

I think i maybe traveled 80 yards. That means i would have to accelerate fast and he didnt get me for accelerating fast which is a whole another offense. So if i didnt accelerate fast and the distance i traveled was very little then i couldnt get to that speed by the time he saw me. That means this ticket is not possible

VERY good advice. I took a ticket to court to argue that I was written the ticket for 10 - 15 more than I was going, but I was still speeding.

The judge said at the beginning of the day, "if you are here to argue that you were not doing the speed on your ticket, but you know you were still speeding, save us both some time. If you have not had a ticket in the last year and plea no contest I will only charge you court cost."

I won the case. The cop didnt even show up. The ticket was 111 dollars.
